1. Scope
For all orders placed via our online shop, only the following General Terms and Conditions in their version valid at the time of the order shall apply. We do not recognise conflicting or deviating terms, unless we expressly agree to their validity in writing.
Our online shop is primarily aimed at consumers within the meaning of § 13 BGB (German Civil Code).
2. Conclusion of Contract
The purchase contract is concluded with Cynthia und Steffen Weidner GbR (trade name: NatureBark).
By placing products in the online shop, we make a binding offer to conclude a contract. You can initially place products in the shopping cart without obligation and correct your entries at any time before submitting the binding order. The contract is concluded when you click the order button and thus accept the offer for the goods contained in the shopping cart.
You will receive an email confirmation immediately after submitting your order.
The contract language is German.
For security reasons, the contract text is not permanently available online.
3. Delivery
Delivery times apply from the time of our order confirmation or, for advance payments, from receipt of payment. Unless otherwise stated, the maximum delivery time is 6 weeks (working days Mon-Fri). The exact delivery time can be found on the respective product page.
Note: If you choose a payment method such as Klarna Invoice or PayPal "Pay Later", the contract for payment is concluded not with us, but with the respective payment service provider.
The payment period begins independently of our delivery time. A delay in delivery does not postpone the payment due date.
Partial deliveries are permissible, provided they are reasonable for you. Any additional costs will only be incurred with the first partial delivery.
Shipping costs are shown during the ordering process and are borne by the buyer.
Returns due to failed delivery
If an order cannot be delivered due to incorrect address information, refusal of acceptance, non-collection or similar circumstances for which the buyer is responsible, and is returned to us, we reserve the right to withhold the goods until the shipping costs have been paid again.
A new shipment will only be made after payment of the additional shipping costs incurred. The buyer will be informed of this by e-mail and given a reasonable period to respond. If no response or payment is received within this period, we reserve the right to withdraw from the contract after a reasonable period has elapsed. In this case, we will refund payments already made – minus the original shipping costs.
4. Prices and Payment Processing
All prices include statutory VAT and are exclusive of shipping costs. Before submitting your order, you will receive an overview of all incurred costs.
The following payment methods are available:
-
PayPal (no customer account required)
-
Credit card
-
Giropay
-
Apple Pay
-
Google Pay
-
Gift voucher
-
Invoice & Klarna
No additional fees apply for any payment method.
Gift vouchers can only be redeemed in our online shop, cannot be combined with other vouchers and are not redeemable for cash.
Note on payment service providers (e.g. Klarna, PayPal "Pay Later"):
If these payment methods are selected, the purchase contract for payment processing is concluded not with NatureBark, but directly with the respective payment service provider.
For payment inquiries (e.g., extension of payment deadlines, reminders), please contact the respective provider directly.
5. Revocation and Return
Exclusion of the right of revocation for personalized products
According to § 312g para. 2 no. 1 BGB, there is no right of revocation if:
-
the goods are not prefabricated and
-
are manufactured according to customer specifications or
-
are clearly tailored to the personal needs of the customer.
➡️ This applies in particular to all products with the note "Custom", "personalizable", "special order" or similar indications.
To make this legally secure, the purchase of these products only takes place if you expressly agree in the ordering process that:
-
NatureBark begins production before the expiry of the revocation period,
-
and you acknowledge that this extinguishes your statutory right of revocation in accordance with § 356 (5) BGB.
This consent is actively given by ticking a checkbox before completing the order.
Once we have started production, there is no longer a right of revocation. A return or exchange is excluded.
Revocation for standard products (not personalized)
For non-personalized standard products, a right of revocation of 14 days applies.
Prerequisite:
-
The goods are in an unused, undamaged, and resalable condition.
-
The return costs are borne by the buyer.
Partial refund for defects:
We reserve the right not to refund the full purchase price upon return if:
-
the goods are damaged,
-
show visible signs of use or soiling,
-
are not returned completely,
-
are not in their original condition.
The refund will be made using the same payment method that was used for the order.
6. Liability for Defects and Warranty
The statutory liability for defects applies.
Defects assumed by us:
-
Transport damage
-
Obvious production defects
-
Heavily worn goods upon delivery
We do not assume liability for damages caused by improper use, e.g.:
-
Use contrary to product instructions (e.g., using a leash on a collar despite a warning notice)
Please report defects immediately with meaningful photos to: info@nature-bark.de
The delivered goods remain our property until full payment (retention of title according to § 449 BGB).
7. Liability
For claims due to damages, we are only liable in cases of:
-
Intent or gross negligence
-
Injury to life, body or health
-
Claims under the Product Liability Act
-
Breach of essential contractual obligations
-
Expressly given guarantees
Otherwise, liability is excluded.
8. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection regulations of your country of residence remain unaffected.
For entrepreneurs: The place of jurisdiction is 17349 Lindetal.
9. Sales at Fairs and Events
Purchases made directly on-site at fairs, markets, or similar events are not distance contracts within the meaning of § 312c BGB.
Therefore, for these sales, there is no statutory right of revocation.
An exchange or return of goods purchased on-site is excluded – unless there is a verifiable material defect within the scope of statutory liability for defects.
10. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):
